Terms of Service for Northern Talent School Inc.

1. Introduction and Acceptance of Terms
These Terms of Service (the “Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Northern Talent School Inc. (“Northern Talent School Inc.,” “we,” “us,” or “our”), a talent-school business located at 412 8th Avenue SE, Calgary, AB T2G 0K9, Canada.
By accessing our website, registering for classes, purchasing services, attending sessions, submitting information, or otherwise using our services, you agree to be bound by these Terms and all policies referenced herein. If you do not agree, you must not use our services.
If you are using our services on behalf of a minor, you represent that you are the parent, legal guardian, or authorized representative and that you have authority to accept these Terms on their behalf.
2. Scope of Services
Northern Talent School Inc. provides talent-development and performance-training services, which may include:
- Vocal coaching
- Acting and stage performance classes
- Public speaking and presentation training
- Dance and movement workshops
- Audition preparation sessions
- Youth talent development programs
Services may be delivered in person, online, one-on-one, or in group settings, depending on the program. We may modify class formats, schedules, instructors, venue locations, capacity, and curriculum content as necessary to maintain quality and operational effectiveness.
Unless expressly stated otherwise in writing, our services are educational and developmental in nature and do not guarantee admission, selection, representation, employment, performance bookings, contests, scholarships, or other professional opportunities.
3. User Obligations and Responsibilities
You agree to:
- Provide accurate, current, and complete information during registration and throughout your use of the services;
- Ensure that all information submitted on behalf of a minor is truthful and complete;
- Comply with all applicable laws, regulations, venue rules, and instructor directions;
- Attend sessions punctually and behave respectfully toward instructors, staff, other participants, and venue personnel;
- Use equipment, facilities, and materials safely and only as instructed;
- Not engage in harassment, discrimination, bullying, violence, disruptive conduct, or any conduct that may endanger others;
- Not record, photograph, distribute, or publicly share class content, performances, or participant images without prior authorization where required;
- Not use our services for any unlawful, fraudulent, or improper purpose.
You are responsible for ensuring that participants are physically and mentally able to participate in the selected activity. Some services may involve physical exertion. You should consult a physician or other qualified professional before participating if you have concerns regarding health, injuries, or limitations.
Northern Talent School Inc. may remove, suspend, or refuse service to any participant who violates these Terms, compromises safety, or disrupts the learning environment, without liability except as expressly required by law.
4. Payment Terms and Conditions
Fees, package prices, registration charges, and any applicable taxes will be disclosed before purchase or enrollment. Unless otherwise stated, all prices are in Canadian dollars (CAD).
- Payment is due in full at the time of booking unless a payment plan is expressly offered in writing.
- We may use third-party payment processors. By paying, you agree to comply with the processor’s terms and conditions.
- You are responsible for all charges, including applicable GST/HST and any bank or card processing fees where permitted by law.
- Late payments, chargebacks, or failed payments may result in suspension of services, administrative fees, or collection efforts to the extent permitted by law.
Promotional pricing, discounts, and scholarships, if offered, may be subject to separate eligibility criteria and may be withdrawn or modified at any time before acceptance, unless prohibited by law.
We reserve the right to correct pricing errors. If a pricing error is discovered after you have paid, we may contact you to offer a refund, an adjusted price, or cancellation where required by law.
5. Cancellation and Refund Policy
Cancellations and refunds are governed by the following policy unless a program-specific policy is provided in writing:
- Individual classes or sessions: Cancellations made at least 48 hours before the scheduled start time may be eligible for rescheduling or a refund, at our discretion and subject to administrative fees where permitted by law.
- Late cancellations and no-shows: Missed sessions or cancellations made less than 48 hours before the start time are generally non-refundable.
- Programs, workshops, and multi-session packages: Refunds may be limited once the program has commenced, services have been delivered, materials have been issued, or a participant’s spot has been reserved.
- Cancellation by Northern Talent School Inc.: If we cancel a service and cannot reasonably reschedule it, we may provide a refund or credit for the unused portion, as required by law or as otherwise determined by us.
Requests for cancellation or refund must be submitted in writing to our contact details listed below. Any refund issued will be processed using the original payment method where practicable.
Nothing in this section limits any non-waivable rights you may have under applicable consumer protection laws in Canada or Alberta.
6. Liability Limitations
To the fullest extent permitted by applicable law, Northern Talent School Inc., its directors, officers, employees, contractors, instructors, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profit, loss of opportunity, loss of data, or business interruption, arising out of or relating to your use of the services.
To the fullest extent permitted by law, our total aggregate liability for any claim arising from or related to the services will not exceed the amount paid by you to Northern Talent School Inc. for the specific service giving rise to the claim during the three (3) months preceding the event giving rise to the claim.
We do not exclude or limit liability where such exclusion or limitation is prohibited by law, including liability for fraud, wilful misconduct, gross negligence where such limitation is not permitted, or any other liability that cannot be lawfully excluded.
Participation in performance, dance, voice, and movement-related activities involves inherent risks, including physical strain, minor injury, emotional discomfort, and damage to personal property. You assume all such risks to the extent permitted by law. You remain responsible for supervising minors unless we have expressly agreed in writing to provide supervision.
7. Intellectual Property Rights
All content, materials, curricula, lesson plans, exercises, choreography, audio-visual materials, logos, trademarks, website content, designs, and other proprietary materials provided by Northern Talent School Inc. are owned by or licensed to Northern Talent School Inc. and are protected by applicable intellectual property laws.
- You may use our materials solely for your personal, non-commercial participation in our services.
- You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, sell, license, or otherwise exploit our materials without our prior written consent.
- Any feedback, suggestions, or ideas you submit may be used by us without restriction or compensation, unless prohibited by law.
Where participants create performances, recordings, or content during classes, ownership and usage rights may be governed by separate written agreements or release forms. In the absence of such an agreement, Northern Talent School Inc. retains all rights in its pre-existing materials, and no implied transfer of rights is granted.
8. Data Protection and Privacy
We collect, use, store, and disclose personal information in accordance with applicable privacy laws in Canada, including the Personal Information Protection and Electronic Documents Act (PIPEDA) where applicable, and relevant provincial laws.
Personal information may include contact details, emergency contacts, payment information, health or accommodation-related information where necessary, attendance records, performance assessments, photos, videos, and communications with us.
We may use personal information to:
- Provide and administer services;
- Process payments and manage accounts;
- Communicate with participants and guardians;
- Maintain safety, security, and incident records;
- Improve and evaluate our programs;
- Comply with legal and regulatory obligations;
- Obtain and manage consent for media, marketing, and program participation where applicable.
We may disclose personal information to service providers, payment processors, insurers, legal advisors, regulators, or others where necessary for service delivery, legal compliance, or protection of rights and safety.
We take reasonable administrative, technical, and physical safeguards to protect personal information, but no system is completely secure. To the extent permitted by law, we are not responsible for unauthorized access caused by factors beyond our reasonable control.

9. Force Majeure
Northern Talent School Inc. will not be liable for delay or failure to perform its obligations due to events beyond its reasonable control, including but not limited to natural disasters, severe weather, fire, flood, epidemic or pandemic, public health emergency, labour disputes, power outages, internet failures, equipment malfunction, government actions, war, terrorism, civil unrest, venue unavailability, or supply chain interruptions.
In such circumstances, we may suspend, modify, reschedule, or cancel services as reasonably necessary. Where feasible, we may offer alternative arrangements, credits, or refunds as required by law or as determined by us.
10. Changes to Terms
We may update or revise these Terms from time to time to reflect changes in our services, operational needs, or legal requirements. The updated Terms will be effective when posted on our website or otherwise communicated to you, unless a later effective date is stated.
Your continued use of our services after the effective date of updated Terms constitutes acceptance of the revised Terms. If you do not agree to the changes, you must discontinue use of the services.
11. Applicable Law and Jurisdiction
These Terms and any dispute, claim, or controversy arising out of or relating to them, the services, or your relationship with Northern Talent School Inc. shall be governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Subject to any rights that cannot be waived, you agree that the courts located in Calgary, Alberta shall have exclusive jurisdiction and venue over any dispute arising from or relating to these Terms or the services.

13. Severability Clause
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or other competent authority, that provision will be severed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
If any invalid or unenforceable provision can be modified to make it valid and enforceable, it will be deemed modified to the minimum extent necessary to reflect the original intent of the parties, to the fullest extent permitted by law.
These Terms constitute the entire agreement between you and Northern Talent School Inc. concerning the services, unless supplemented by a separate written agreement signed by Northern Talent School Inc.
